Grand jury hands down indictment in City Grill shootings

Buffalo, NY – An Erie County grand jury has indicted a Buffalo man for the City Grill murders. 23 year old Riccado McCray appeared in before Erie County Judge Sheila A. DiTullio late Wednesday morning for his arraignment.

A grand jury has indicated McCray on one count of murder in the second degree, three counts of murder in the first degree, four counts of attempted murder in the first degree and one count of criminal possession of a weapon in the second degree. McCray surrendered to police last week.

Cuffed in shackles and dressed in a white tee shirt and what appeared to be plaid flannel pants, McCray pleaded not guilty to the charges.

McCray's lawyer, Terrence McKelvey told the judge that his client is "adamant about his innocence".

McKelvey also noted that McCray surrendered himself to police when he learned he was wanted for questioning and has remained cooperative.

The only words spoken by McCray at Wednesday's arraignment was "yes mam" when asked if he was aware of his constitutional right to attend all court sessions.

McCray is accused in the shootings of eight people outside the City Grill August 14th on Main Street. Four died and four where injured.

Earlier this week a judge set bail at $500,000 dollars. But Judge DiTulli did not set bail under this latest round of more serious charges lodged against McCray even though his attorney told the judge McCray has no intention of fleeing.

But County District Attorney Frank Sedita said they have evidence that McCray fled to the Carolina's shortly after the shootings where he has relatives.

"We have pretty good information of went, where he was staying and how long he was there. shortly before his arrest he returned to Western New York," said Sedita.

The district attorney also noted that they now have a list of witnesses who identified McCray. Those witnesses are being only identified as "A to E".

Family members of the victims appeared in court to watch the arraignment.

Sedita said the grand jury's investigation concludes there was just one shooter.
